Version 1.3.1

Language priority: For the Türkiye region, the Turkish version is the main version. If the English translation differs, the Turkish version controls to the extent permitted by applicable law.
These Terms govern access to and use of the TeamWorkStation websites, applications, APIs, and related services (collectively, the “Service”). By creating an account, accepting these Terms, accessing, or using the Service, you agree to them. The acceptance record may include the user, date, IP/session information, document path, version, and hash. If you use TWS for an organization, you represent that you have authority to bind it.
The Data Processing Agreement is accepted separately during registration and applies within its own scope.
Nothing in these Terms limits rights that cannot lawfully be waived, including mandatory consumer, data-protection, intellectual-property, or liability rights.
Account means a registered TWS user account. Board means an isolated collaborative workspace containing members, Cards, Templates, files, forms, workflows, announcements, or other resources. Card means a structured information unit managed in a Board. Template means a reusable Card definition. Public Content means Content intentionally published for public access. Content means files, documents, forms, comments, announcements, images, text, metadata, and other information submitted to the Service. Owner means the designated primary Board owner. Authorized User means a user granted access under the Board permission model. Subscription means a free or paid plan.
You must have legal capacity to enter into these Terms and must provide accurate registration information. You are responsible for credentials and activity under your Account and must promptly report unauthorized access. You must not share credentials or use another person’s Account without authorization.
Subject to these Terms, TWS grants a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purposes. No ownership in the Service is transferred. TWS and its licensors retain all rights in the Service, including software, interfaces, trademarks, and documentation. Open-source components remain subject to their applicable licenses.
You retain ownership of your Content. You grant TWS a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit, display, and make Content available only as reasonably necessary to provide, secure, maintain, support, troubleshoot, and improve the Service.
The license ends when the Content is permanently removed, except for copies retained under law or reasonably necessary for backup, security, audit, dispute resolution, or technical integrity. You are responsible for having the rights, notices, consents, and legal bases needed for Content you submit or share.
Owners and Authorized Users may manage Board access only within their assigned permissions. You are responsible for checking permissions before sharing confidential, regulated, personal, or sensitive information. TWS is not responsible for a User’s access decisions or for a user-configured public link.
Public Card Trees and Personal Web Spaces may be accessible to anyone on the Internet. Public Content may be indexed, cached, copied, archived, or retained by third parties after you remove it. You remain responsible for ensuring that public material does not violate law, confidentiality, privacy, intellectual-property, or contractual duties.
TWS is generally a controller for account, authentication, billing if enabled, security, support, legal-compliance, and platform-operation processing. For personal data placed in Board Content by an organization or Board Owner, that organization or Owner will generally be the controller and TWS will generally act as processor on documented instructions, subject to the applicable Data Processing Agreement. TWS may separately act as controller for security, abuse prevention, support, legal, and operational activities.
Board Owners and Users must provide required notices, select a lawful basis, configure access appropriately, and respond to requests concerning people whose data they control. Additional details are in the Privacy Policy and KVKK Information Notice.
The production application, user databases, user files, and backups are stored in AWS's Istanbul Local Zone, Türkiye. These core TWS data are not transferred outside Türkiye for storage. This storage service's resilience is not an automatic backup service. The local development configuration may use the local filesystem. Depending on the selected features, Google services may involve processing outside Türkiye. The executed Article 9 standard contract applies to Google Workspace transfers; other transfers use legally applicable transfer mechanisms. Backups may also be stored, when needed, on company-owned servers located in Türkiye and using encrypted disks.
API access requires authentication and permissions. Availability, quotas, authentication methods, and rate limits may change. You are responsible for API credentials and actions performed through them. Third-party integrations are governed by their own terms.
AI features, if enabled, may produce inaccurate output or actions. You must review and validate outputs and remain responsible for permissions granted to an AI agent. AI is not legal, financial, medical, professional, or safety-critical advice.
You must not use the Service to upload or distribute unlawful Content; malware; phishing, fraud, impersonation, or social engineering; infringing material; unauthorized personal data; spam or scams; unauthorized scraping or credential harvesting; or to bypass security, access controls, quotas, or rate limits. You must not interfere with the Service or use it for cryptocurrency mining or resource-intensive workloads unrelated to ordinary platform use.
TWS may throttle or restrict use that is abusive, excessive, automated, harmful, or inconsistent with ordinary use, including storage, bandwidth, API, public-publishing, and automation use. TWS relies on hosting, storage, authentication, email, DNS, certificates, open-source, and other providers. TWS is not responsible for failures outside its reasonable control, but will take reasonable steps to restore Service and protect data.
The Service is provided on an “AS AVAILABLE” basis and may be affected by maintenance, defects, Internet, browser, DNS, certificate, storage, infrastructure, or provider failures. Features, APIs, interfaces, limits, providers, regions, and deployments may change or be discontinued. Where reasonably practical, TWS will seek to preserve compatibility with existing data.
Authenticated users may download a sanitized database copy and, where permitted, Board, Card, or personal file folders. Exports may contain authorized information about other Board members. Export does not grant access beyond existing permissions.
Account deletion is available through account settings. It deletes the user database and user file storage and attempts to clean connection data in other user databases. It does not automatically remove historical references or Content created by others. The production backup process creates weekly backups. Production database backups are retained for 30 days and, under ordinary conditions, are deleted on a rolling basis after that period; backups may retain deleted data during that period.
TWS may suspend or terminate access, public publishing, or API access where reasonably necessary for a material breach, unlawful activity, non-payment when paid services are enabled, security, protection of users or infrastructure, or legal compliance. Where the risk is not urgent, TWS will provide notice and a reasonable opportunity to remedy the issue where practical. You may stop using the Service or request account deletion at any time.
After termination, TWS may retain data as described in the Privacy Policy and may provide export only while technically and legally feasible. Provisions that by their nature survive termination remain effective.
Rights holders may contact info@teamworkstation.com with a sufficiently detailed complaint. TWS may restrict allegedly infringing Content where required by law or reasonably necessary to manage risk, and will consider a lawful counter-notice or clarification where appropriate.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TWS does not promise uninterrupted, error-free, completely secure, permanently available, or loss-free operation, and does not warrant AI output or third-party services.
Software defects, incorrect configuration, maintenance, infrastructure, or provider failures may cause data loss, corruption, temporary unavailability, or failure to restore data from backups. Backups do not guarantee that every item will be preserved or recoverable in every situation. Users should maintain additional copies of important data as appropriate for their needs.
TWS has infrastructure for restoring data from backups. If data loss occurs, TWS may use an appropriate backup where technically feasible and where no other reasonable option remains. This capability does not mean that any particular data or operation will be restored successfully.
To the maximum extent permitted by law, TWS is not liable for indirect or consequential commercial losses. This does not exclude or limit liability that cannot lawfully be excluded or limited, including liability arising from willful misconduct or gross negligence where prohibited, death or personal injury, mandatory consumer rights, or statutory data-protection obligations. For other claims, TWS’s aggregate liability will not exceed the fees paid for the Service during the twelve months before the event giving rise to the claim, or, for a free Service, the Turkish-lira equivalent of USD 100, whichever is higher. This cap does not apply to willful misconduct, gross negligence, mandatory consumer rights, non-waivable data-protection responsibilities, or other liability that cannot lawfully be limited.
To the extent permitted by law, you are responsible for third-party claims arising from your unlawful Content, public publishing, misuse of the Service, violation of these Terms, infringement of third-party rights, or unauthorized processing of personal data, limited to reasonable, direct, and finally determined claims. TWS will give reasonable notice and allow you to participate in the defense. This does not require you to indemnify TWS for TWS’s own breach, willful misconduct, or non-waivable legal liability.
We may update these Terms for legal, security, technical, or product reasons. The version and date identify the current text. Material changes will be communicated through appropriate channels and will become effective no earlier than the date stated in that communication where required. If you do not accept a material change, you may stop using the Service and request account deletion; continued use after the effective date constitutes acceptance only to the extent permitted by law.
These Terms are governed by the laws of the Republic of Türkiye, without prejudice to mandatory rights in the User’s place of residence. A consumer may use the competent consumer arbitration committee or consumer court and any other forum granted by mandatory law. For disputes with a User acting as a business or commercial enterprise, the competent courts and enforcement offices of Ankara, Türkiye, will have jurisdiction unless mandatory law provides otherwise.
Before paid plans are enabled, TWS will provide pricing, tax, renewal, cancellation, withdrawal, refund, and digital-service pre-contract information together with separate subscription terms where required. These Terms alone do not create a paid subscription or payment instruction.
